The U.S. Citizenship and Immigration Services released a new version of the I-9 Employment Eligibility Verification form on July 17. Employers may use the new version or the prior version until Sept. 17, 2017. Beginning on Sept. 18, 2017, the new version of the I-9 must be used for any new verifications. Individuals who received a Form I-94 at the time of entry into the United States should visit I-94 Website to view and print a copy of their I-94. This document is an acceptable List A receipt for Form I-551, Permanent Resident Card.

How do I open an I-9 form?

Go to https://www.uscis.gov/i-9. After clicking on the I-9 link to open the form, there should be a dialogue box in the lower, left-hand corner of the screen that says “I-9. pdf open with ^.” Click on the arrow and select “Always open with system viewer.”

Department of Justice enforces the Form I-9 anti-discrimination provisions. A key piece of the hiring process, the Form I-9 employment eligibility verification, has an upcoming deadline with which all U.S. employers must comply. The U.S. Citizenship and Immigration Services (USCIS) recently released a revised form with a revision date of November 14, 2016. While employers will be allowed to use either the current form or the new form through January 21, 2017, the new form will be mandatory effective January 22, 2017. U.S. citizens, recent permanent residents, temporary residents, asylees and refugees are protected from citizenship status discrimination. However, permanent residents who do not apply for naturalization within six months of eligibility are not protected from citizenship status discrimination. Citizenship status discrimination which is otherwise required to comply with law, regulation, executive order or government contract is permissible by law.

Accordingly, USCIS will automatically extend through Feb. 5, 2025, the validity of DED-related Employment Authorization Documents (EADs) with a Card Expires date of Feb. 5, 2023. You must reverify the employee’s employment authorization before their extension ends. USCIS field offices recently started delivering Forms I-94 with ADIT (temporary I-551) stamps as temporary evidence of LPR status without requiring an in-person appearance at the field office.

New I9 Form to be released July 17, 2017

Once a new employee has completed Form I-9, Employment Eligibility Verification, create a case in E-Verify for this employee. If the employee presented their EAD that has been automatically extended, enter the EAD document number you entered on Form I-9, as well as the automatically extended date of March 3, 2024. You must reverify these employees on Form I-9 before they start work on March 4, 2024. Locate An Office

If an in-person appointment is not needed, a USCIS field office will then review the request for temporary evidence and mail the applicant a Form I-94 with ADIT stamp, DHS seal and a printed photo of the LPR obtained from USCIS systems.
